• ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR SERVICES;

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pequod's Pizza and its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

EXCEPT AS SET FORTH IN SECTION 14.4 BELOW, ALL DISPUTES, CONTROVERSIES, OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR THE SERVICES — INCLUDING QUESTIONS OF ARBITRABILITY — SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT.

Arbitration shall be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), as modified by this Agreement. The arbitrator shall have exclusive authority to resolve any dispute relating to the formation, applicability, enforceability, scope, or waiver of this arbitration agreement. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

YOU AND PEQUOD'S PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and Pequod's Pizza waive any right to a jury trial and waive any right to participate in a class or representative action.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency or injunctive relief in any court of competent jurisdiction to prevent irreparable harm, protect intellectual property rights, or preserve the status quo pending arbitration.

15. Compliance with Consumer Protection Laws

Pequod's Pizza operates in compliance with applicable federal and state consumer protection laws, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce.
